Shared Service Agreement for the Toms River Animal Shelter

Thank you Ocean County Board of Health for providing the final Shared Services Agreement between Toms River Township and the Ocean County Board of Health for the management and operation of the Animal Shelter located in Toms River (Toms River Municipal Clerk has not responded to the OPRA request…needed more time). The Agreement is attached, but let’s review the highlights:

  • Toms River Township remains responsible for all Animal Control Services and costs for same.
  • Toms River Township will place in deposit and in trust, with the Ocean County Board of Health the remaining balance of the testamentary bequest the Township received from the Estate of Jeanne Pyne. The township CFO will be provide a certification of funds (attached to agreement). Funds shall be held in trust and may be utilized for actual repairs, renovations, upgrades, startup costs and maintenance of the Toms River Animal Shelter and the care of the animals.
  • The Township of Toms River agrees to provide snow and ice removal, as well as all exterior landscaping services and insect pest control of the grounds and perimeter of the building. The Township will provide for trash removal from the property on the same schedule as the police station at least twice per week.
  • Either party may terminate this Shared Services Agreement upon 180 days notice of the parties intention to terminate. In the event this agreement is terminated prior to its expiration then in that event the Township shall reimburse the Board for the cost of any major improvements or repairs made to the facility during 12 months preceding the notice of termination and the balance of the fund shall be returned to the Township.
  • This Shared Services Agreement shall have an initial term of 10 years.
  • The Ocean County Board of Health shall be considered the lead agency and all employees shall be employed by the Ocean County Board of Health.
  • The remaining balance of the Fund is $654,986.13, including a $490 payment on December 20, 2024 by Toms River Township as directed by Judge Brenner in the case Philip Brilliant v. Toms River Township
