
On January 22, 2025 an investigation was initiated into the Holiday City Organization Phase II regarding theft of Homeowners Association funds by the Executive Board. The investigation was undertaken by the Ocean County Prosecutors Office and through the investigation it was discovered that Lynn O’Toole is the President of the Homeowner’s Association; Lynn O’Toole is also Councilwoman for Toms River Township.
The outcome of the investigation is that there is insufficient evidence, and this case does not rise to the level of a criminal prosecution. The case was closed and referred to the Department of Consumer Affairs regarding the management of the HOA.
The entire file obtain through OPRA is attached with names of witnesses redacted to protect them from retaliation.

Hi…as a resident of said HOA, I am appalled at the outcome. Aside from the obvious (stealing) and the fact that this case was “mysteriously ” closed, there are further concerns. First….how was it that she was allowed to be investagated in the town that she’s a council woman. My brother is a Judge and I could never be tried in his county (I’m just his sister!). Then, there’s election fraud (we have proof) that they never even touched upon. Disgusting. I will move because of her. For some reason, she is untouchable. Thanks
You join many with the sentiment and we wish we had advice or a way to fix what is broken in Toms River. Did you see the kick and destroying of signs by Justin Lamb against David Ciccozzi? That was dismissed by the Judge, as there was not enough evidence. Lynn and many others are bad people and one day their luck will run out. I do know there are a few civil litigation cases going on, so hopefully that will have a positive result. But we won’t stop!
